Able Fitness Terms and Conditions
This agreement is an agreement between you the “member” and Able Fitness (Peterborough) Limited (Able Fitness)
This agreement commences once you have indicated your acceptance in the Declaration section of the web sign up process. You have 14 full days after signup to cancel this agreement for any reason. To exercise this right, please email your membership cancellation requested to [email protected] within the first 14 days. Follow receipt of your email, Able Fitness will confirm your cancellation request via email. If you exercise this right to cancel we will refund your Membership Fee received from you, the member, using the same means of payment you used for the initial transaction, provided that you have not used or utilised any of the gyms facilities,
products or services. You will be entitled to all the rights and privileges exercisable for the type of membership chosen, Subject the successful processing of your Direct Debit instruction.

Memberships
Persons wishing to become members of Able Fitness Gym are required to complete the membership sign up process on the website during the sign up phase.
Able Fitness reserves the right to reject any application for membership without further reason.
By ticking the ‘agree to Terms and Conditions’ box the member agrees to comply with these Terms and Conditions of Membership.
You will only be permitted to access the gym and classes provided your membership is current and fully paid.
Minimum age to become a member is 12. If you are aged between 12-17, you must sign up at the gym with relevant ID and a parent or guardian. Junior Members are only permitted to attend junior classes unaccompanied by an adult. Gym use for Junior Members is only permitted with an adult over the age of 18 present.
Able fitness offer different categories of membership. Your choice of membership on joining will determine the fees you pay and any restrictions that may apply.
You may change to another category of membership by giving a one-month notice period and paying the required membership fee.

Memberships Period/Contracts
When agreeing to join Able Fitness you are agreeing to a “Rolling Contract”. Your membership will automatically continue on a rolling monthly basis following your commitment period requiring 30 days’ notice to terminate from your next scheduled payment date.
If notice is given on your actual date of payment then the 30 days’ notice will serve from then however, should you terminate your contract midway through the month you will be required to pay the remaining period of the month and notice will be accepted from the 1st month and your 30 day period will commence.

Membership Fees
Able Fitness will set the level of Membership fees and reserves the right to change the level of fees from time to time. The following fees prevail:

Membership fee; the level of membership fees shall be determined according to the type of membership you have signed up to, i.e. Gym Able, Junior Able or Fully Able

Able Fitness will set all other fees and prices for the sale of goods at the goods, merchandise and any other services from time to time.
Unless otherwise stated, the Club takes no responsibility for advance payments made to freelance Personal Trainers (PT’s); in this instance, it is your responsibility to enter into an agreement with the freelance PT’s Membership Fees are NON-REFUNDABLE under any circumstances.
Unless otherwise stated, pre-sale Early Bird membership offers (where applicable) will be valid for 6 months after the gym opening date. At the 6-month point, Early Bird memberships will automatically increase to the current relevant membership fee.
Should your monthly member payment fails from your account, Able Fitness will contact you to advise you of this.
Should any membership fees not be paid within 30 days of the due date, the full membership fee for the remainder of the commitment period will automatically become due and payable in full.

All membership fees are reviewed periodically. For any changes to the monthly fee, we will give you at least 30 days’ notice.

Termination by you, the Member
Please note that you have a period of 14 days from sign-up in which to cancel your
Membership. This right to cancel will cease once you attend the gym and/or utilise any of the facilities or classes or the period of 14 days has elapsed, whichever is the earlier.
After the first month, you can cancel your membership by giving us notice. Your request should be made in writing to [email protected]
Stopping payment of your membership fees is not the same as giving notice. If you stop paying, but do not give us notice, you are still obligated to pay the fees. As mentioned above, we reserve the right to refer any missed payments to a debt collection agency. We, or our agents, may charge a fee for missed payments.
You are required to give [email protected] 30 days’ notice to cancel your membership from your next scheduled payment date. Any payment due during that period will be your last and your membership will continue for the period you have paid for.

Termination of your membership by Able Fitness
We may terminate our agreement in the following circumstances:
‣ If you commit a serious or repeated breach of this agreement
‣ If your membership fee remains unpaid 30 days after its due date for payment;
‣ If you provide us with details which you know to be false;
‣ If you engage in any illegal activity or activity which we deem to be unacceptable behaviour;
‣ If Able Fitness terminate for any of the above reasons, we reserve the right to retain a proportion of your
membership fees paid under this agreement

Health & Safety
Members must read all Health and Safety notices displayed at Able Fitness and comply with their recommendations.

Able Fitness has a zero tolerance policy on the use, sale or purchase of illegal drugs or non-prescription drug within the gym and reserves the right to eject, terminate and ban any member or guest found to be partaking in these acts.
Members will be required to complete a Health Commitment Statement prior to signing up for a membership.

Able Fitness Liability Policy
Able Fitness will not accept liability for any loss, damage to or theft of personal property of members and guests.

Amendments & Changes
Able Fitness may amend the terms and conditions of their membership at any time by reasonable notice, including but not limited to posting new terms on our website www.ablefitnessgym.co,uk, these amended terms and conditions shall be binding upon publishing
